Safari Operator Agreement

1. Purpose
This Safari Operator Agreement governs the relationship between SafariCalc and any safari operator, tour company, destination management company or travel business using the SafariCalc platform.
By creating an operator account, publishing content, submitting verification documents or using SafariCalc business tools, you agree to be bound by this Agreement.
2. Eligibility
Operators must operate a legitimate tourism business, hold all licences required by applicable law, maintain legally required insurance where applicable, have authority to enter into this Agreement and provide accurate registration information.
SafariCalc may request supporting documentation at any time.
3. Operator Responsibilities
The operator is solely responsible for all published itineraries, pricing accuracy, availability, descriptions, photographs, booking confirmations, traveller communication, payments collected, refunds, cancellations, travel documents, service quality and legal compliance.
SafariCalc provides publishing, management and marketplace tools only.
4. Membership
Use of SafariCalc may require an active membership. Membership plans, pricing and included features are published on SafariCalc and may change from time to time.
Failure to maintain an active membership may result in suspension of publishing privileges, marketplace visibility or access to operator tools.
5. Verification Programme
Participation in SafariCalc's verification programme may require operators to submit company registration documents, government-issued identification, proof of ownership, official website information and other documents reasonably requested by SafariCalc.
SafariCalc reserves the right to approve, reject, suspend or revoke verification at its sole discretion.
A verification badge remains the property of SafariCalc and may not be copied, modified or displayed outside SafariCalc without permission.
6. Publishing Content
Operators are responsible for ensuring that all published content is accurate, lawful, not misleading, does not infringe copyright and belongs to the operator or is properly licensed.
SafariCalc may edit formatting, resize images and optimise content for presentation without altering its meaning.
7. Pricing
The operator remains solely responsible for all published prices.
Although SafariCalc provides automated pricing tools, operators must verify every published itinerary before making it available to travellers.
SafariCalc accepts no responsibility for operator pricing mistakes.
8. Enquiries and Bookings
All enquiries received through SafariCalc belong to the operator receiving the enquiry.
The operator agrees to respond promptly, communicate professionally, honour confirmed bookings, maintain accurate availability and provide agreed services.
9. Future Marketplace Features
SafariCalc may introduce online bookings, payments, messaging, reviews, invoicing, commission programmes or additional marketplace services.
Where additional terms become necessary, SafariCalc may publish supplementary policies or require operators to accept updated terms.
10. Reviews
Travellers may submit reviews regarding their safari experience.
SafariCalc reserves the right to moderate, investigate or remove reviews that are fraudulent, abusive, defamatory or otherwise violate platform policies.
Operators may not manipulate, purchase, fabricate or pressure travellers for misleading reviews.
11. Intellectual Property
The operator retains ownership of uploaded content, subject to the licence granted to SafariCalc.
By publishing content, the operator grants SafariCalc a worldwide, perpetual, royalty-free, non-exclusive licence to display, promote, advertise, resize, optimise, translate, archive and distribute that content solely for operating and promoting SafariCalc.
12. Prohibited Conduct
Operators must not publish false itineraries, publish misleading prices, upload copyrighted material without permission, submit fake reviews, misrepresent verification status, interfere with SafariCalc systems, use automated scraping tools, upload malicious software or engage in fraudulent activity.
13. Suspension
SafariCalc may suspend or permanently terminate an operator account where it reasonably believes fraud has occurred, documents are falsified, travellers are being misled, laws have been violated, this Agreement has been breached or continued use could damage SafariCalc or its users.
14. No Employment Relationship
Nothing in this Agreement creates a partnership, employment relationship, agency relationship or joint venture between SafariCalc and the operator.
Operators remain independent businesses.
15. Indemnification
The operator agrees to indemnify and hold harmless SafariCalc, its directors, employees, contractors and affiliates against claims arising from published itineraries, pricing, traveller disputes, accidents, legal violations, copyright claims or breach of this Agreement.
16. Limitation of Liability
SafariCalc shall not be liable for loss of revenue, bookings, profits, goodwill or indirect damages arising from the operator's use of the platform.
17. Changes
SafariCalc may update this Agreement periodically.
Continued use of the platform after changes become effective constitutes acceptance of the revised Agreement.
18. Governing Law
This Agreement shall be governed by the laws applicable to SafariCalc's registered jurisdiction unless mandatory consumer protection laws provide otherwise.
