1. Introduction
Welcome to SafariCalc. SafariCalc is an online platform designed to help African safari tour operators create, manage, publish and promote safari itineraries while allowing travellers to discover, compare and enquire about safari experiences offered by independent operators.
These Terms and Conditions govern your access to and use of the SafariCalc website, platform, software, applications, services, content and related features.
By accessing SafariCalc, creating an account, publishing content, submitting an enquiry, using any SafariCalc service or otherwise interacting with the platform, you confirm that you have read, understood and agreed to be legally bound by these Terms.
If you do not agree with these Terms, you must not use SafariCalc.
2. Definitions
For the purposes of these Terms:
- SafariCalc means the SafariCalc website, platform, software, applications and related services.
- Operator means any safari company, tour operator, travel agency, destination management company or tourism business using SafariCalc.
- Traveller means any visitor, user or customer using SafariCalc to browse, compare, enquire about or book safari experiences.
- Listing means any safari itinerary, tour package, destination, lodge, activity, service, price, media or other item published on SafariCalc.
- Content means text, photographs, videos, itineraries, logos, prices, documents, business information and other material uploaded, submitted or published through SafariCalc.
- Verified Operator means an operator that has completed SafariCalc’s verification process.
3. Acceptance of These Terms
By using SafariCalc, you confirm that you are at least 18 years old or otherwise legally capable of entering into binding agreements under applicable law.
If you use SafariCalc on behalf of a company, you confirm that you have authority to bind that company to these Terms.
4. Eligibility
SafariCalc may refuse registration, suspend access or terminate accounts where false information has been provided, fraud is suspected, documents cannot be verified, previous accounts have been suspended, or use of the platform would violate applicable laws.
5. SafariCalc Services
SafariCalc provides software and marketplace services including safari itinerary creation, pricing tools, proposal generation, public safari listings, operator profiles, traveller enquiries, search features, media management and related business tools.
SafariCalc may modify, suspend, add or remove services at any time.
6. User Accounts
Users are responsible for maintaining the confidentiality of their login credentials and for all activity conducted through their accounts.
You agree to provide accurate account information, keep your information updated and notify SafariCalc immediately if you suspect unauthorised account access.
7. Safari Operators
Operators represent and warrant that they legally operate their business, possess required licences and registrations, comply with applicable tourism laws, maintain appropriate insurance where required, and provide accurate information through SafariCalc.
Operators remain solely responsible for their itineraries, prices, availability, descriptions, images, services, communications, booking terms and fulfilment of safari arrangements.
8. Travellers
Travellers agree to provide accurate enquiry and booking information, communicate respectfully with operators, review itinerary details carefully and comply with the booking conditions of the selected operator.
Travellers are responsible for obtaining passports, visas, vaccinations, travel insurance and any other requirements necessary for travel.
9. Marketplace Role
SafariCalc operates as an independent technology platform and marketplace.
Unless expressly stated otherwise, SafariCalc is not a safari operator, travel agency, accommodation provider, transport provider or guide service. SafariCalc does not own safari vehicles, operate lodges, employ guides or directly provide safari experiences.
Any booking contract is formed directly between the traveller and the operator. SafariCalc is not a party to that contract unless expressly stated otherwise.
10. Verification Programme
SafariCalc may offer a verification programme to help travellers identify operators who have completed additional identity and business verification.
Verification may include review of company registration documents, identification documents, business ownership information, website ownership and other checks determined by SafariCalc.
A verified badge confirms only that an operator completed SafariCalc’s verification process at the time of approval. Verification is not a recommendation, warranty, guarantee of quality, guarantee of pricing accuracy, guarantee of traveller satisfaction, guarantee of future conduct or guarantee of financial stability.
SafariCalc may suspend or revoke verification at any time if information becomes inaccurate, misleading, incomplete or fraudulent.
11. Bookings
Unless expressly stated otherwise, SafariCalc facilitates communication between travellers and independent safari operators.
Operators are responsible for confirming availability, accepting or rejecting bookings, issuing travel documents, arranging services, providing accommodation, transport and guiding, and fulfilling all confirmed safari arrangements.
12. Pricing
Operators are solely responsible for the accuracy of prices displayed on SafariCalc.
Although SafariCalc provides automated pricing tools, operators remain responsible for reviewing and confirming all prices before publication or communication to travellers.
SafariCalc does not guarantee that prices, taxes, park fees, exchange rates, lodge rates or government charges will remain unchanged.
13. Payments
SafariCalc currently facilitates enquiries between travellers and operators. If SafariCalc introduces online payment processing, additional payment terms may apply.
Payment providers may impose separate terms and conditions. Operators remain responsible for services sold unless expressly stated otherwise.
14. Cancellations and Refunds
Cancellation and refund policies are determined by each operator unless SafariCalc expressly provides otherwise.
Travellers should carefully review operator cancellation terms before confirming any booking. SafariCalc is not responsible for cancellation charges, refund decisions or booking changes imposed by operators.
15. Intellectual Property
SafariCalc owns all intellectual property relating to its name, logo, software, source code, databases, platform design, graphics, trademarks and original content.
No rights are granted except as expressly stated in these Terms.
16. User Content
Operators and users retain ownership of content they upload, subject to the licence granted below.
By uploading or publishing content on SafariCalc, you grant SafariCalc a worldwide, non-exclusive, royalty-free licence to display, reproduce, optimise, resize, distribute, promote, archive and use that content for the operation, improvement and promotion of SafariCalc.
You warrant that you own or have permission to use all content you upload.
SafariCalc may remove content that infringes copyright, violates laws, misleads travellers, is offensive, damages SafariCalc’s reputation or violates these Terms.
17. Prohibited Activities
Users must not:
- Provide false or misleading information.
- Impersonate another person or company.
- Publish fake prices, fake availability or fake reviews.
- Upload malicious software or harmful code.
- Attempt unauthorised access to SafariCalc systems.
- Scrape or copy platform data without permission.
- Spam users or misuse communication tools.
- Infringe intellectual property rights.
- Use SafariCalc for unlawful purposes.
18. Suspension and Termination
SafariCalc may suspend, restrict or terminate any account if it reasonably believes that these Terms have been violated, fraudulent activity has occurred, documents are falsified, illegal activity is suspected or continued access may harm SafariCalc, users or third parties.
SafariCalc may remove any listing at its discretion where necessary to protect platform integrity.
19. Third-Party Services
SafariCalc may integrate with third-party services such as payment processors, analytics providers, maps, hosting services, email tools and social media platforms.
SafariCalc is not responsible for the availability, security, policies or actions of third-party services.
20. Limitation of Liability
To the fullest extent permitted by applicable law, SafariCalc shall not be liable for direct, indirect, incidental, consequential, punitive or special damages arising from or related to:
- Safari bookings or enquiries.
- Operator conduct or failure to perform.
- Cancellations, delays or itinerary changes.
- Accommodation, transport or guide issues.
- Visa refusals, health requirements or travel documents.
- Wildlife behaviour or missed wildlife sightings.
- Weather, road conditions or seasonal changes.
- Government restrictions, strikes, epidemics or pandemics.
- Natural disasters, political unrest or force majeure events.
- Loss of profit, business, goodwill, data or reputation.
Nothing in these Terms excludes liability where such exclusion is prohibited by law.
21. Indemnification
You agree to indemnify, defend and hold harmless SafariCalc, its owners, directors, employees, contractors, affiliates and partners from claims, liabilities, damages, losses, legal costs and expenses arising from your use of SafariCalc, breach of these Terms, uploaded content, infringement of third-party rights or services you provide or purchase through the platform.
22. Force Majeure
SafariCalc shall not be liable for failure or delay caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, labour disputes, government action, internet outages, cyber attacks, power failures, epidemics or pandemics.
23. Governing Law
These Terms shall be governed by the laws of the jurisdiction in which SafariCalc is legally established, unless mandatory consumer protection laws provide otherwise.
Any disputes shall be submitted to the competent courts of that jurisdiction unless applicable law requires otherwise.
24. Changes to These Terms
SafariCalc may update these Terms from time to time. Material changes may be communicated through the platform, by email or by updating the effective date above.
Continued use of SafariCalc after changes become effective constitutes acceptance of the revised Terms.
25. Electronic Acceptance
By creating an account, publishing content, submitting an enquiry, clicking “I Agree” or otherwise using SafariCalc, you acknowledge that your electronic acceptance has the same legal effect as a handwritten signature to the extent permitted by applicable law.
